Directors’ Duties Under The Companies Act 2006

Conformity of Local Plans to Structure Plans – Petition for Judicial Review by Bellway (Scotland) Ltd

On 9 July 2008 Lord Carloway delivered the Opinion of the court in refusing an appeal by Bellway (Scotland) Limited under section 238 of the 1997 Act against the decision by Stirling Council to adopt Alteration 2 to the Stirling Local Plan 1999 and thereby allocate the second respondent’s site at Durieshill as the “Major Growth Area” for housing.
