Affordable Housing
The affordable housing sector has undergone rapid and radical evolution in recent decades. We have played a full part in that evolution, along with existing clients and contacts, developing an understanding of the culture in which you operate, and assembling a team of lawyers with expertise in every area of the law allowing your business aims and customer service objectives to be fulfilled.
We advise some of Scotland's largest and most active registered social landlords (RSLs) and provide a full range of services, from simple conveyancing in a land purchase to co-ordinating and driving forward large and complex transactions involving many parties from all disciplines involved in the process. It is in these more complex projects that our experience is of greatest benefit to our clients. A great deal of preparatory work can be required, including finding a structure for the transaction, negotiating with other partners including funders and carrying out due diligence on any land, property or other assets which the RSL may be acquiring. All of these factors bear significantly on the outcome and success of any deal. We can bring added value to the team in the efficient delivery of these large scale, complex multiparty projects.
Our corporate team includes lawyers who specialise in the "not for profit "and Charity Sector. They can also advise on strategy, assisting you to identify the best corporate structure for the delivery of your objectives and the set up/restructure of your organisation in compliance with charity regulation, the appropriate regulatory framework and general governance issues.
Our service also includes advice on a broad range of operational/grievance matters, from construction contracts to employment issues, dispute resolution and general litigation.
As such, we offer a complete legal service package to all our clients in the affordable housing sector.

*UPDATE: The Property Factors (Scotland) Act 2011 is due to come into force on 1st October 2012. Housing Associations which manage the common parts of land used to any extent for residential purposes are classified as 'property factors' (s2) for the purposes of the Act and therefore this new legislation will have a direct impact on the services that Housing Associations provide.
