Litigation & Employment Law
Given a choice, we would probably all prefer to avoid litigation. It can be time-consuming, frustrating and expensive. Wherever possible, our litigation team will help you resolve disputes before they escalate into court-action. However, where mediation or arbitration is not an option, we'll act robustly to achieve the best result for you.
We have a practical approach: At the outset, we'll assess the strength of your case, your options and likely outcomes and provide an estimate of the cost. We take a commercial view and if we believe the cost is likely to exceed any award you'll receive, we'll say so.
We act for both pursuers and defenders in tribunals and the courts at all levels, from the Sheriff courts and Court of Sessions to the House of Lords.
Alternative Dispute Resolution
We can provide both arbitration and mediation services and have a good track-record in resolving disputes through ADR. Where we believe involving third parties can help break deadlocks, we bring in experts on a 'without prejudice' non-binding basis.
Commercial litigation
Our litigators deal with a wide range of contentious matters, including commercial and contract disputes, debt recovery/insolvency, defamation, employment, environmental, health & safety, insurance, interdicts, judicial reviews, personal injury, planning, property (including leasing) and professional negligence. We are particularly known for our property litigation where we've acted in a number of high-profile cases, including a landmark case for Safeway (now Morrisons) on 'keep open' clauses.
Employment
All employers are concerned about the apparent increase in regulation and employee rights. Our experienced lawyers will provide a service that should avoid or minimise the risk of you facing expensive claims. From advising on the correct contents of employee and company director contracts through to ensuring that you follow the correct procedures if disciplinary or grievance procedures arise, we can help you avoid having to deal with an Employment Tribunal.
If formal proceedings are unavoidable, whether that be in the Employment Tribunal or Civil Court, our expertise will ensure that your interests are well protected. Remember, the vast majority of claims against employers are successful because of the employer's failure to follow proper procedure. Consult us now before problems arise and avoid the pitfalls. Services that we can provide are:-
- Preparation or revisal of employment contracts or contracts for the services of company directors.
- Grievance and disciplinary procedures.
- Managing change of personnel and practice in the workplace.
- Implement of non discriminatory policies and procedures.
- Enforcement of contractual rights including intellectual property rights, restrictive covenants etc.
- Unfair dismissal, breach of contract and discrimination claims.
